Goldacre Overturned

The decision of HH Judge Purle QC in the Birmingham Chancery Court has been overturned by the Court of Appeal. The case which required an administrator or liquidator to pay a full quarter's rent if in occupation of a premises for the purposes of futhering an administration or liquidation on a quarter day, has been overturned.  Conversely if the administrator or liquidator did not take occupation until the day after the quarter day, they paid nothing if they exited before the next quarter day.  Now administrators and liquidators will  pay an apportioned rent on a day to day basis as an expense of the insolvency.
